The patent office looks at the relative ability of a granted patent to consistently meet the requirements for patentability. Patent quality generally falls into three categories: the underlying innovation; the writing of the patent document; and meeting the legal requirements including novelty (§102), non-obviousness (§103) and written description (§112).
